CONDITION OF SALES
In these Conditions Kayastone Worktops Ltd
(A) Quotations are given in good faith in the light of our delivery position and subject to the availability of the materials. Every effort will be made to effect delivery within the quoted period, but no liability can be accepted should it be exceeded.
(B) Quotations are based on current costs and are subject to amendment on or after acceptance to meet any recognized rise or fall in such costs, unless specified to the contrary on the quotation form. Such rise or fall will apply at date of despatch irrespective of date of order.
(C) Quotations are based unless otherwise stated on our standard range of stocked colours.
3. PRICES.
Goods are supplied at prices ruling at date of despatch.
4. ORDERING CONDITIONS.
In the event of a customer’s official order form containing any special conditions, it is understood that such are only binding in so far as they are not at any variance with terms and conditions mentioned here with.
5. SPECIAL ORDERS.
Orders for goods which are not shown as stock items in our official stock list must be placed in writing. We cannot accept verbal cancellation on special items; such request to cancel must also be in writing. The right to refuse cancellation of orders in the case of goods in transit, ready for despatch, or in process of manufacture.
6. SHADING.
(A) Natural Stone tiles should be dry-laid in the first instance so that you can rearrange to suit; as a product of nature, variation of colour, shading, veins, marking and texture are to be expected.
(B) Kayastone Worktops Ltd will not accept responsibility for mixed shades after tiles have been fixed.
7. VALUE ADDED TAX.
VAT will be charged as an extra at the foot of the invoice at the current rate applicable.
8. PAYMENT.
Before final delivery can be made all monies must be paid in full.
9. SIGNATURES.
Unexamined or other similar qualified signatures will not be binding on Kayastone Worktops Ltd.
10. AFTERCARE.
Advice regarding cleaning, maintenance or general aftercare should be requested from a member Kayastone Worktops Ltd so that information appropriate to your purchase can be supplied.
11. SHORTAGE CLAIMS.
No claims for shortage on delivery can be entertained unless specified at time of delivery. The total number of items will be shown on all delivery notes and signature notes which must be checked by the receipt on delivery.
12. DAMAGE CLAIMS.
(A) No claims for damage to worktops, tiles, mirrors, sanitary ware or unboxed items can be entertained once our driver has left the premises. Any such item becoming transit to our customer must be deleted from the signature note and the driver to retain the item on the vehicle.
(B) Claims for damage relating to boxed items which have not been examined by the customer at the time of delivery. Kayastone Worktops Ltd, must be the subject of a written claim to be received by the depot which delivered the goods and Kayastone Worktops Ltd in writing within 3 days of receipt of goods. Valid claims for damage in transit on our vehicle or relating to a manufacturing fault will not be considered for credit providing:
(B.i) We are notified of the correct delivery note against which goods were supplied. (We supply a Copy of the delivery note with each delivery)
(B.ii) Every care is taken to ensure that no damage or additional damage is occasioned to the goods and that they are returned in their original packaging.
(b.iii) Where considered necessary by Kayastone Worktops Ltd, its representative is given access to inspect before return of goods.
13. FAULTY ITEMS.
Goods must be examined prior to assembly or fixing. Kayastone Worktops Ltd will not accept responsibility for faulty items once assembly or fixing has commenced, except in so far as the manufacturer in turn is prepared to take responsibility. No tiles are guaranteed against crazing.
14. CREDITS.
In general, we cannot accept the return of goods for credits where such goods have been correctly supplied to order. Where, however we agree voluntarily to such a return, a handling charge of 25% will be made. In this circumstance no credit can be given unless, the goods are returned in perfect condition suitable for re-sale by Kayastone Worktops Ltd.
15. RETURN OF GOODS POLICY
STOCK TILES
1) We will accept full boxes only.
2) Original invoice must be presented at time of returning tiles.
3) Tiles must be returned within 7 days of purchase. The customer will then have the following choices:
a) 25% handling charge if a refund is required.
b) A full credit with no handling charge.
UK DISTRIBUTION SPECIAL ORDERS
1) Minimum of three boxes must be returned.
2) Original invoice must be presented at time of returning tiles.
3) Our suppliers must authorize the returning of the tiles before we accept the return of the tiles.
4) A 25% handling charge will be made plus any carriage charges.
SPECIAL FOREIGN ORDERS
1) No returns accepted under any conditions.
ALL OTHER UK SPECIAL ORDER RETURNS
1) Our supplier must authorize the returning of the goods.
2) A 25% handling charge will be made plus any carriage charges
3) Cheque/Charge card refunds are processed at time of returning tiles.
16. RESERVATION OF TITLE.
The ownership of the goods shall only pass to the purchaser when they have paid all that is owing to Kayastone Worktops Ltd shall have a general lien on all goods in the purchaser’s possession (although such goods or some of them may have been paid for) for the unpaid price of goods supplied to the purchaser under the same or any other contract. A Kayastone Worktops Ltd representative shall have the right to enter any premises owned or occupied by the purchaser for the purpose of collecting such goods. Not with standing this reservation of title, the purchaser shall have full responsibility for all risks relating to goods whilst in the purchaser’s possession.
